Nutty Gear Studio Surf Terms of Service Edition dated 22 September 2026 Surf is a Nutty Gear Studio service. Nutty Gear Studio is the studio name used by the Operator identified below, not a separate legal entity. Full details appear in “Operator details” in this document. Prohibited material now explicitly includes pornography and other sexually explicit material and graphic scenes of violence or cruelty. The other terms of use, scope of data processing and consent are unchanged. 1. Contracting party The Operator identified in “Operator details” provides Surf to users habitually resident outside the Russian Federation. This party is referred to as the “Operator”, “we” or “us”; the other party is the user accepting these terms. Interface language and Apple account region do not determine the contracting party. Report a change of habitual residence to support@nuttygearstudio.com. A change of operator requires a separate arrangement and does not operate retrospectively. 2. Access and accounts Surf is a free service for publishing videos and selecting a video stream. Registration is available from age 16, subject to mandatory applicable requirements. If applicable law requires a legal representative’s involvement to enter this contract or grant rights in material, obtain the necessary permission before taking that action. Provide an accurate date of birth and country of residence, keep account credentials confidential and report compromised access. Do not bypass age restrictions or account restrictions, or impersonate another person. If inaccurate information is identified, the Operator may restrict access and request proportionate verification of age or country of residence. Errors can be corrected through support. Selecting a lower content rating does not change the user’s age. 3. Rights in uploaded material By uploading material, you confirm that you hold all rights and permissions needed for its use in Surf under these terms. This includes video, music, sound recordings, performances, images, text and other protected elements, as well as necessary permissions from depicted persons. You need not be the sole author where a valid licence or the law permits the relevant use. Buying a recording, subscribing to a music service, crediting its author or finding no prohibition does not by itself authorise publication of music in Surf. You are responsible for payments to rightsholders arising from the material you supply where required. Provide evidence of rights upon a substantiated request; access may be restricted pending review. Material infringing third-party rights, unlawful content, sexual exploitation of minors, pornography and other sexually explicit material, graphic scenes of violence or cruelty, threats, harassment and activities compromising service security are prohibited. An age label does not make prohibited material acceptable. 4. Licence to operate Surf Ownership remains with the relevant rightsholders. By providing material, you grant the Operator a royalty-free, non-exclusive worldwide licence for the duration of its placement to reproduce and store it, make technical copies, transcode, resize and crop it, extract frames and excerpts, analyse its content, generate descriptions, translations and age assessments, include it and its excerpts in personalised streams, publicly display it and make it available through Surf. You permit technical changes necessary for these purposes, without authorising distortion that infringes non-waivable personal rights. The Operator may engage technical contractors and grant them the rights needed for these operations only within the operation of Surf. This does not grant them independent rights to sell your material. This licence does not automatically authorise separate training of a third party’s general-purpose model. After deletion, the licence ends for further public use. Restricted copies may remain to the extent necessary by law, to handle a dispute or to complete technical deletion; this does not authorise continued public display. Copies already obtained by third parties may be outside our control. 5. Selection and moderation Automated analysis assists video selection and age assessment but may make mistakes. We may review material manually, change its rating, limit distribution, reject or remove it for violations, substantiated complaints, security risks or legal requirements. We do not undertake to publish every upload or guarantee views, revenue or a particular position in a stream. A rating filter is not a guarantee that each frame is suitable for a particular child or a substitute for adult supervision. 6. Rightsholder notices Submit notices through the Rightsholders section or support@nuttygearstudio.com, identifying the work, specific Surf material, grounds, authority and return contact details. Where sufficiently grounded, we promptly take necessary measures, including restricting access or removal; a prior response from the uploader is not a prerequisite for such action. Users may submit objections and supporting evidence of rights. Mandatory applicable procedures, notices and deadlines remain effective. Repeated or serious substantiated violations may lead to account restrictions or termination. We may preserve necessary restricted evidence and disclose information only on a lawful basis. A notice alone does not establish infringement or guarantee permanent removal. 7. Service operation and liability To the extent permitted by law, Surf is provided “as is” and “as available”. We give no additional warranties of uninterrupted or error-free operation, accurate automated analysis, compatibility with every device or indefinite file preservation. Keep your own originals: Surf is not a contractual archival storage service. The Operator is not liable for lost profits or indirect losses to the extent permitted by applicable law. The limitations and exclusions of liability in these terms apply only to the extent permitted by law and do not restrict mandatory user rights. Where your culpable breach of these terms or third-party rights results in substantiated claims against the Operator, you must reimburse documented losses and reasonable necessary costs to the extent permitted by applicable law and causally connected to that breach. We will notify you of the claim and give you an opportunity to participate in its defence. Reimbursement under a settlement is limited to obligations you have agreed to. 8. Termination and changes You may stop using Surf and request account deletion in Data and consents or contact support. The Operator may restrict access for violations, legal requirements or service protection; reasons and appeal procedures will be provided where legally required. Material changes to these terms are communicated before application, with renewed acceptance where necessary. They do not retrospectively alter rights and obligations already accrued. 9. Governing law These terms are governed by the law of Georgia. This choice does not deprive you of mandatory protections applicable in your habitual residence or legally available rights to bring proceedings. Contact support@nuttygearstudio.com. Invalidity of one provision does not invalidate the remaining terms. Russian and English editions are intended to express the same terms; differences are resolved with regard to mandatory law and the text actually accepted by the user. Operator details Individual Entrepreneur Aleksandr Ilichev, registration number 345635379, registered in Georgia with LEPL National Agency of Public Registry. The Operator operates under the studio name Nutty Gear Studio. This is the contracting party to these terms. Contact: support@nuttygearstudio.com.
